We analyze web traffic information: IP addresses, browsers, and number of clicks to generally track users movement, analyze trends to gather broad demographic information for marketing purposes.

GENERAL TERMS AND CONDITIONS
Allure NYC, LLC will provide design and database development for your project. Allure is in no manner responsible for earnings and or losses from site/applications. Allure will offer technical support which is subject to additional fees; Allure is not responsible for technical errors made on self admin portions of your site. Estimates are based on the specifications in documents supplied; any scope creep or deviation from the specs in said documents will affect the price and development time of the project. Estimates are valid for 14 days after issuance and are a one time design/programming and setup fee; as such the site will be released only upon receipt of final payment. Any deposits/payments are non refundable once development commences. To ensure adhesion to the project development schedules, client agrees to deliver content and edits by dates specified; failure to do so can delay the completion of the project. Delaying the development or launch of the project does not delay the payment or payment schedules. Late or non payments are subject to late fees and suspensions of development, service and support (including hosting and email). Hosting is renewed yearly on the date of issuance of your hosting. Late fees for hosting begin at 30 days of issuance date and the site is subject to suspension. Once hosting has been suspended there will be services fees to reactivate your hosting. If you have fallen into suspension you will need a credit card retainer for future billing. Domains, SSL certificates and any other cost, renewal, etc. associated with the site is the sole responsibly of the site owner.

Development Completion and Launch are two separate entities. Launching your site is arbitrary and dependant on the client. Delaying the launch of your site does not delay final payment due at development completion. Only after final payment is made will site files be released to the client.
Once development is complete, final payment is made and files released, Beta testing is recommended for larger of more complex systems. Any “bugs” or technical issues found during Beta testing will fall under the free technical support if the site resides on Allure NYC’s Hosting service and falls within the scope of the development agreement. Anything additional to or outside the original scope on the development agreement will be subject to additional fees. Technical issues may require troubleshooting prior to fix and can take some time to fix.
Any additional development needed after the completion of a project and release of site files will be treated as a separate project with agreed to cope and price.
Development:
Content/edits/other necessary info are not received in a timely manner, within 1-2 days of dates on schedule the project may loose its spot in the internal production schedule until the information is delivered. Once information is delivered, the project will commense in an open spot in internal production schedule. Please note that any late content/info delivery from client will effect all schedules, development time and completion date. Delaying content and development of the site does not delay the payment schedule. Payments not made according to schedule will be subject to suspension of development. If your project is suspended for any reason all development ceases and the project will be dropped from the internal production cycle until the proper payment is made. Once payment is made including late fees development will commense at a open date in production schedule. Suspension of development delays completion dates.
Technical support: Allure NYC offers technical support on all system builds. This service is offered as a courtesy to all our hosting clients at no charge, as long as
(1) the support requested is within the confines of the of agreed to development specs
(2) not the result of an admin user
(3) the account is paid up and in good standing – no monies are owed for hosting domain ssl development consultation or any other service Allure NYC has provided.
Any site not residing on Allure’s servers and not utlitizing Allure’s hosting services may still receive technical support at a per instance fee. If major troubleshooting is required there maybe an additional charge for this service base on time and manpower. Any support/fixes needed due to resulting from an administrator or admin user will accrue service fees.
Hosting Service:
Hosting Service are yearly contracts and to be paid on a yearly basis from the hosting inception date. Hosting payments are non-refundable. The yearly fees are based on type of server, service, hosting needed per project/customer/site. These fees are subject to increase without prior notice as upgrades, maintenance, etc are needed and done on a routine basis to ensure the level of managed hosting and secure service provided. Termination of hosting requires a 30-day written notice. If notice is given prior to the hosting year end, payment are non refundable. By terminating the hosting service with Allure NYC the free technical support is also terminated.
If move or transfer to another server is requested there is a minimum charge of $450.00, this cost is determined on size and complexity of site, site files, data, etc. and the criteria of new host/server. Also any SSL certificated needed may need to be repurchased, reconfigured and/or installed. Allure can not guarantee time it takes to move files/site as this is heavily dependent on new server/host. Any time spent on the phone with new server is also subject to additional fees. Allure is not responsible for any mishappenings, technical issues, non functioning portions of site. Troubleshooting any issues as a result of move will be subject to service fees. Allure is not responsible for any non-working features due or technical issues due to the inability or lack of criteria needed to make the site function as it did on Allure’s servers.
Email
Allure NYC offers email as a part of the hosting service. This email is accessible through any web browser through your link, username and password.
It is recommended that the email be downloaded to your computer using an email service such as Outlook, Thunderbird, etc. Using these services allows for download and organization of email.
Allure is not responsible for these programs, settings on computers, viruses received in emails, use of or non use of antivirus software, hacking of email or computer, client use of email.
Client agrees to use the email for and within the law and for ethnical and business purposes. Any misuse of the email for fraudulent, unlawful or unethical uses, Allure can Suspend or Terminate the email accounts suspected of such use without notice and has the right the revoke all rights to site(s), emails, data and files.
Allure is not responsible for the ability to receive email on mobile devices. Allure does not supply phone tech service and can not troubleshoot mobile device services, phone features, email setup, etc.
If email is requested to be forwarded to another email service such as Yahoo, Hotmail, Gmail, RoadRunner, Verizon, etc. Allure is not responsible for the email reaching that service or the client. Even if forwarded, it is recommended that you check your mail through the web link supplied to make sure that all emails were forwarded properly.
SEO
Allure codes all sites for SEO and will submit descriptions and initial round of keywords. Allure is not responsible for seo results, where the site will appear in the searches or traffic received from the seo. It is the clients responsiblity to monitor search engine results. There are paid programs that Allure may set up for the site at a fee for management of these programs. Keywords and monetary aspects of these programs are the responsibility of the client.
Site/File Ownership
Once payment is received in full and there are not fee balances left, Allure NYC will release the files to the client. Allure NYC will not claim ownership to the site files after the payments & balances are made if no provisions are made in advance. Allure is not responsible for content, usage, productivity, etc of the site
Site Tagging
As creators of the site, a tag will appear at the bottom of the site with our Company name and link to Allure NYC's site, similar to a photographer credit. Any person's or entities showing Allure NYC's work as their own will be prosecuted. The site may appear in Allure's portfolio and be presented to clients/future clients as samples of work. Allure will not show any information considered privy to the site/company such as database structure, data, client info and files/orders, etc.
